Enquadramento legal:
1. Decreto-Lei n.º 104/2021, de 27 de novembro: Altera as medidas no âmbito da pandemia da doença COVID-19;
2. Resolução do Conselho de Ministros (RCM) n.º 157/2021, de 25 de novembro, publicada no Diário da República, 1.ª série, de 27 de novembro de 2021: Declara a situação de calamidade no âmbito da pandemia da doença COVID-19;
3. Decreto-Lei n.º 105-A/2021, de 30 de novembro: Estabelece o regime do formulário de localização de passageiros.
Deveres dos destinatários das normas (Transportadoras aéreas, Entidade gestora aeroportuária e Passageiros)
1. Transportadoras aéreas:
a) Até às 23:59 do dia 9 de janeiro de 2022:
i) Só devem permitir o embarque dos passageiros de voos com destino ou escala em Portugal continental mediante a apresentação, no momento da partida, de comprovativo de realização TAAN ou TRAg para despiste da infeção por SARS-CoV-2 com resultado negativo, realizado nas 72 ou 48 horas anteriores à hora do embarque, respetivamente / Verificação da existência do referido teste no momento da partida [1]. ou
ii) Certificado Digital COVID da UE nas modalidades de certificado de teste ou de recuperação, previsto, respetivamente, nas alíneas b) e c) do n.º 1 do artigo 4.º do Decreto-Lei n.º 54-A/2021, de 25 de junho.
b) Medidas especiais em matéria de testagem até às 23:59h do dia 9 de janeiro de 2022:
i) Se transportar passageiros provenientes de países que integram a União Europeia e dos países associados ao Espaço Schengen (Liechtenstein, Noruega, Islândia e Suíça) que não sejam portadores de certificado de recuperação ou comprovativo de realização de teste, e que testem positivo em teste realizado à chegada, devem suportar os custos inerentes ao alojamento onde o passageiro vai ficar em confinamento obrigatório (caso o mesmo não disponha de local adequado para o efeito) e à respetiva alimentação.
c) Das 0:00h do dia 10 de janeiro de 2022 até às 23:59 do dia 20 de março de 2022:
i) Só devem permitir o embarque dos passageiros de voos com destino ou escala em Portugal continental mediante a apresentação, no momento da partida, de comprovativo de:
-
Realização TAAN ou TRAg para despiste da infeção por SARS-CoV-2 com resultado negativo, realizado nas 72 ou 48 horas anteriores à hora do embarque, respetivamente / Verificação da existência do referido teste no momento da partida [2]; ou
-
Certificado Digital COVID da UE admitido nos termos do n.º 1 do artigo 5.º do Decreto-Lei n.º 54 -A/2021, de 25 de junho, ou certificado digital relativo a uma vacina contra a COVID-19 com autorização de introdução no mercado, que tenha sido objeto de uma decisão de execução da Comissão Europeia; ou

Comprovativo de vacinação que ateste o esquema vacinal completo nos termos do n.º 2 do artigo 4.º do Decreto-Lei n.º 54-A/2021, de 25 de junho, há pelo menos 14 dias, com uma vacina contra a COVID -19 com autorização de introdução no mercado, cujo reconhecimento tenha sido determinado pelo despacho previsto no n.º 2 do artigo 5.º do Decreto-Lei n.º 54 -A/2021, de 25 de junho.
d) A partir das 0:00h do dia 16 de dezembro de 2021:
i) Devem garantir que todos os passageiros que embarquem com destino ou escala em Portugal continental dispõem, em formato digital ou em papel, do comprovativo de preenchimento do formulário de localização de passageiros, denominado a nível da União Europeia Passenger Locator Form (PLF), e impedir o embarque àqueles que não o apresentem. Até esta data não é obrigatória a apresentação de comprovativo de preenchimento de PLF pelo passageiro (ainda que seja recomendável), não sendo, em consequência, a falta de apresentação pelo passageiro motivo para recusa de embarque, nem a falta de exigência por parte da transportadora aérea motivo para processo de natureza sancionatória.
ii) Devem informar os passageiros da obrigatoriedade de preenchimento do PLF (Nos sítios da Internet e nos postos de atendimento ou de venda ao público, nos postos de atendimento existentes nos aeródromos nacionais com transporte aéreo comercial de passageiros, bem como no momento da confirmação da reserva de bilhete e de realização do check-in eletrónico ou presencial).
2. Entidades gestoras aeroportuárias (ANA):
a) Disponibilizar testes laboratoriais TAAN ou TRAg, através de profissionais de saúde habilitados para o efeito;
b) Efetuar o rastreio de temperatura corporal por infravermelhos a todos os passageiros que chegam a território nacional continental, e, se necessário, medição de temperatura corporal;
c) Encaminhar os passageiros com temperatura igual ou superior a 38°C para um espaço adequado à repetição da medição da temperatura corporal, devendo esses passageiros, se a avaliação da situação o justificar, ser sujeitos a teste TRAg;
d) Implementar um sistema de verificação do cumprimento do disposto na alínea q) do artigo 2.º do Decreto-Lei n.º 28-B/2020, de 20 de junho, na sua redação atual, pelos passageiros através, designadamente, de profissionais da área da segurança privada alocados para o efeito. 3. Passageiros:
a) Passageiros que sejam cidadãos nacionais e cidadãos estrangeiros com residência legal em território continental, bem como pessoal diplomático colocado em Portugal que, excecionalmente, não sejam portadores de teste, devem:
i) Realizar, à chegada, antes de entrar em território continental, teste TAAN ou TRAg, a expensas próprias;
ii) Seguir, para o efeito, as indicações das autoridades competentes;
iii) Aguardar em local próprio, no interior do aeroporto, até à notificação do resultado.
b) Caso o passageiro embarque com um comprovativo de realização de teste TRAg que não cumpra os requisitos previstos nos n.ºs 9 e 1do art. 19.º da RCM, deve, à chegada e antes de entrar em território nacional:
i) Realizar novo teste TAAN ou TRAg, a expensas próprias;
ii) Aguardar em local próprio, no interior do aeroporto, até à notificação do resultado.
c) Na chegada ao aeroporto, se acusar uma temperatura corporal igual ou superior a 38.ºC, deve seguir para o espaço indicado para o efeito, para efeitos de medição de temperatura corporal e, se necessário, ser sujeito a teste TRAg.
d) Passageiros nacionais de países terceiros sem residência legal em território nacional que embarquem sem o teste TAAN ou TRAg – é recusada a entrada em território nacional.
e) Medidas especiais em matéria de testagem até 23:59 do dia 9 de janeiro de 2022:
i) Passageiros provenientes de países que integram a União Europeia e dos países associados ao Espaço Schengen (Liechtenstein, Noruega, Islândia e Suíça) que se verifique à chegada não serem portadores de certificado ou comprovativo de realização de teste devem realizar, nesse momento, a expensas próprias, teste TAAN ou TRAg;
ii) Caso o teste realizado tenha resultado positivo, o passageiro deve cumprir o confinamento obrigatório em local identificado pelas autoridades competentes, a expensas da transportadora aérea em que haja viajado até Portugal, caso não disponha de local adequado para o efeito.
f) É obrigatório o uso de máscaras ou viseiras na utilização de transportes coletivos de passageiros, incluindo o transporte aéreo.
g) A partir das 0:00h do dia 16 de dezembro de 2021:
i) Preencherem o PLF, após a realização do check-in e antes da hora de embarque, no caso de serem passageiros de voos com destino ou escala em Portugal continental (disponível, nas línguas portuguesa e inglesa, no portal Clean & Safe, gerido pelo Instituto do Turismo de Portugal, I. P. (Turismo de Portugal, I. P.), disponível em https://portugalcleanandsafe.pt/pt-pt/passenger-locator-card).
h) Sugere-se a todos os passageiros a consulta antes de viajar e aquando da programação da viagem do site da Comissão Europeia em https://reopen.europa.eu/en; https://reopen.europa.eu/pt/map/PRT/7011, onde a informação já está atualizada com as mais recentes restrições, e tem muita informação relevante para os passageiros sobre todas as restrições em vigor em cada um dos países.
I. Exceções às medidas aplicáveis em matéria de entrada em território nacional por via aérea
Estão isentos da aplicação das regras respeitantes à entrada em território nacional, por via aérea, designadamente em matéria de apresentação de testes ou de certificados que os substituam e de isolamento profilático (quando aplicável):
a) As aeronaves de Estado;
b) As Forças Armadas;
c) Aeronaves que integram ou venham a integrar o DECIR;
d) Voos para transporte exclusivo de carga e correio;
e) Voos de emergência médica;
f) Escalas técnicas para fins não comerciais;
g) Tripulantes de aeronaves.

a) Os cidadãos nacionais e os cidadãos estrangeiros com residência legal em território nacional e seus familiares, bem como o pessoal diplomático colocado em Portugal, que embarquem sem o teste em voos com origem em países africanos de língua oficial portuguesa e em voos de apoio ao regresso dos cidadãos nacionais ou titulares de autorização de residência em Portugal continental ou de natureza humanitária.
b) Os menores de 12 anos de idade.

Press Release 18/2021 - Air Travel: Legal measures concerning the calamity situation in connection with the COVID-19 pandemic disease in mainland Portugal

Legal framework:
1. Decree-Law 104/2021, of 27 November: Amends the measures within the scope of the COVID-19 disease pandemic;
2. Resolution of the Council of Ministers (RCM) no. 157/2021, of 25 November, published in the Diário da República, 1st series, of 27 November 2021: Declares a state of emergency in the context of the COVID-19 disease pandemic;
3. Decree-Law no. 105-A/2021, of 30 November: Establishes the regime of the passenger tracing form.
Duties of the stakeholders of the regulations (Air carriers, Airport managing body and Passengers)
1. Air carriers
(a) Until 23:59 of 9 January 2022:
- (i) Must only allow passengers on flights to or from mainland Portugal to board upon presentation, at the time of departure, of proof of TAAN or TRAg for screening for SARS-CoV-2 infection with negative result, performed within 72 or 48 hours prior to the time of boarding, respectively / Verification of the existence of the said test at the time of departure [1]. or
- ii) EU COVID Digital Certificate in the modalities of test certificate or recovery certificate, foreseen respectively in paragraphs b) and c) of no. 1 of article 4 of Decree-Law no. 54-A/2021, of 25 June.
b) Special measures for testing until 11:59 pm on January 9, 2022:
- i) If transporting passengers from countries within the European Union and from countries associated to the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland) who do not hold a recovery certificate or proof of having been tested, and who test positive in a test carried out on arrival, they must bear the costs inherent to the accommodation where the passenger will be in compulsory confinement (if there is no suitable place available for that purpose) and the respective food.
c) From 00:00 of 10 January 2022 until 23:59 of 20 March 2022:
- (i) Shall allow passengers on flights to or from mainland Portugal to board the aircraft only on presentation, on departure, of proof of:
TAAN or TRAg test for SARS-CoV-2 infection with negative result, performed within 72 or 48 hours prior to the time of boarding, respectively / Verification of the existence of the said test at the time of departure [2]; or
- Digital Certificate EU COVID admitted under the terms of paragraph 1 of Article 5 of Decree-Law no. 54 -A/2021, of 25 June, or digital certificate related to a vaccine against COVID-19 with marketing authorization, which has been subject to an implementing decision of the European Commission; or
- Proof of vaccination attesting the complete vaccination scheme in accordance to number 2 of article 4 of Decree-Law no. 54-A/2021, of June 25, for at least 14 days, with a vaccine against COVID-19 with authorization to be placed in the market, whose recognition has been determined by the dispatch provided for in number 2 of article 5 of Decree-Law no. 54-A/2021, of June 25.
d) From 00:00h of 16 of December 2021:
- (i) Shall ensure that all passengers embarking to or calling at mainland Portugal have, in digital or paper format, proof of completion of the Passenger Locator Card Form, known at European Union level as the Passenger Locator Card Form (PLF), and prevent boarding to those who do not present it. Until that date, the presentation of the proof of completion of the PLF by the passenger is not compulsory (although it is recommended), and therefore the failure by the passenger to present it will not be grounds for denying boarding, nor will the failure by the air carrier to require it be grounds for a penalty procedure.
- ii) They must inform passengers of the obligation to fill in the PLF (on the Internet sites and at the customer service or sales outlets, at the service stations existing in the national aerodromes with commercial air passenger transport, as well as when confirming the ticket reservation and when checking in electronically or in person).
2. Airport managing entities (ANA):
a) Provide TAAN or TRAg laboratory tests, through health professionals qualified for this purpose;
b) Perform infrared body temperature screening to all passengers arriving in mainland Portugal, and, if necessary, measure body temperature;
c) Forward passengers with a temperature equal or above 38°C to a suitable space for the repetition of body temperature measurement, and these passengers,
- if the assessment of the situation so warrants, shall be subject to a TRAg test
d) Implement a system to check passengers' compliance with the provisions of paragraph q) of article 2 of Decree-Law no. 28-B/2020, of 20 June, in its current wording, through, namely, private security professionals allocated for this purpose. 3. Passengers:
(a) Passengers who are national citizens and foreign citizens with legal residence in mainland Portugal, as well as diplomatic staff posted in Portugal who, exceptionally, do not carry a test, must:
- i) Carry out, on arrival, before entering mainland Portugal, a TAAN or TRAg test, at their own expense;
- ii) Follow the instructions given by the competent authorities for this purpose;
- iii) Wait in a special place inside the airport until the result is notified.
b) If the passenger boards the aircraft with a TRAg test certificate that does not meet the requirements of paragraphs 9 and 1 of art. 19 of the RCM, the passenger must, on arrival and before entering the national territory
- i) Perform a new TAAN or TRAg test, at its own expense;
- ii) Wait in a special place inside the airport until the result is notified.
c) On arrival at the airport, if you have a body temperature of 38ºC or higher, you should go to the space indicated for that purpose, for body temperature measurement and, if necessary, undergo the TRAg test.
d) Third country national passengers without legal residence in national territory who board the aircraft without a TAAN or TRAg test - shall be refused entry into national territory.
e) Special measures on testing until 23:59 on 9 January 2022:
i) Passengers coming from countries that are part of the European Union and countries associated with the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland) who upon arrival are found not to be in possession of a certificate or proof of a test must carry out, at their own expense at that time, a TAAN or TRAg test;
- ii) If the test is positive, the passenger must comply with compulsory confinement in a place identified by the competent authorities, at the expense of the air carrier on which they have travelled to Portugal, if it does not have a suitable place for that purpose.
f) The use of masks or visors is compulsory when using public passenger transport, including air transport.
g) From 00:00 of 16 December 2021:
- i) Fill out the PLF, after check-in and before boarding time, in case they are passengers on flights with a destination or stopover in mainland Portugal (available, in Portuguese and English languages, on the Clean & Safe portal, managed by the Instituto do Turismo de Portugal, I. P. (Turismo de Portugal, I. P.), available at https://portugalcleanandsafe.pt/pt-pt/passenger-locator-card).
h) We suggest that all passengers consult, before travelling and when planning their trip, the European Commission website at https://reopen.europa.eu/en; https://reopen.europa.eu/pt/map/PRT/7011, where the information is already updated with the most recent restrictions, and has lots of relevant information for passengers on all the restrictions in force in each of the countries.
I. Exceptions to measures applicable to entry into national territory by air
The following are exempt from the rules concerning entry into national territory by air, namely with regard to the presentation of tests or certificates in lieu thereof and prophylactic isolation (where applicable)
(a) State aircraft;
b) Armed Forces;
c) Aircraft that are or will be part of DECIR;
d) Flights for the exclusive carriage of cargo and mail;
e) Emergency medical flights;
f) Technical stopovers for non-commercial purposes;
(g) Aircraft crews.

(a) National citizens and foreign citizens with legal residence in national territory and their family members, as well as diplomatic personnel stationed in Portugal, who board without the test on flights originating from African countries whose official language is Portuguese and on flights supporting the return of national citizens or holders of residence permits in mainland Portugal or of a humanitarian nature.
b) Children under 12 years of age.
